Terms and Conditions of Sale
The contractual terms for your stay at Villa Danatea in L’Étang-Salé, presented clearly, comprehensively and accessibly.
Article 1 – The owner’s commitment
The owner undertakes to welcome guests personally, or through an appointed representative, with all the care needed to make their stay easier and help them fully enjoy the region.
Article 2 – Booking, advance payment and acceptance of the terms
The online booking system allows you to check availability, submit an enquiry or booking, and confirm availability for your preferred stay. Bookings are accepted up to a maximum of twelve months in advance. Requests beyond this limit cannot be processed without the prior express agreement of the manager, David Grondin, obtained by telephone on +262 692 77 94 14 or by email.
To guarantee the booking, valid credit or debit card details must be provided.
The booking becomes firm and final once Villa Danatea Location Saisonnière has received the requested advance payment. Payment of this advance constitutes full acceptance of these Terms and Conditions, the house rules, the cancellation conditions and the information relating to the booked stay.
Amounts paid when booking are expressly classified under French law as an acompte (a binding advance payment), not arrhes (a withdrawal deposit). The advance confirms the guest’s firm commitment and blocks the booked dates in the calendar. Villa Danatea reserves the right to release the dates until the advance has been received.
Article 3 – Payment of the balance
The balance of the stay must be paid before arrival or no later than the day of arrival, according to the arrangements agreed between the parties.
Accepted payment methods are French cheques, bank transfer, cash and bank card where that method is offered.
Tourist tax is payable in accordance with the regulations, based on the length of the stay and the number of adults accommodated.
For peak periods, Villa Danatea may request payment of the balance before arrival, particularly for periods of high demand, exclusive villa bookings, long stays or bookings made several months in advance.
Article 4 – Cancellation by the guest
All cancellations must be made in writing, by email or another written means that provides a record. The guest acknowledges the absence of a right of withdrawal described in Article 2.
4.1 – Outside peak periods
- Cancellation received at least sixty days before arrival: refund of amounts paid, without a penalty, subject to the non-recoverable fees referred to in Article 4.3.
- Cancellation received thirty to fifty-nine days before arrival: a cancellation charge equal to 25% of the total stay price.
- Cancellation received fifteen to twenty-nine days before arrival: the 50% advance payment is retained by Villa Danatea.
- Cancellation received less than fifteen days before arrival: the full stay price remains payable.
- Failure to arrive on the arrival date without prior cancellation: the full stay price remains payable.
- If the stay is shortened or interrupted, or the guest departs early: the accommodation price is retained.
4.2 – Réunion school holidays, public holidays and other peak periods
Any booking covering all or part of the official Réunion school holidays or a public holiday is a peak-period booking. Where expressly identified at the time of booking, this also includes national school holidays, bridge days, extended weekends, the Grand Raid, the period from 15 December to 15 January and any other period of high demand.
The guest must be clearly informed of this condition before paying the advance. If the guest cancels, the advance is definitively retained by Villa Danatea, regardless of notice, except where mandatory law provides otherwise, in a legally recognised case of force majeure, or under an exceptional written agreement from Villa Danatea.
Less than three months before arrival, the balance may also be required. For a peak-period booking made more than six months in advance, the advance is retained under the same conditions.
4.3 – Bank and transaction fees
Where a full or partial refund is due, non-recoverable bank charges, online payment fees, PayPal fees, platform commissions or other transaction fees remain payable by the guest and are deducted from the refund.
Article 5 – Cancellation by the owner
If Villa Danatea cancels the stay before it begins for a reason attributable to it, the guest will be informed promptly in writing and the amounts paid will be refunded. This refund does not affect any statutory rights the guest may have.
Article 6 – Arrival
The guest must arrive at the time agreed when booking. The usual arrival time is 10:00 am. In case of delay, later arrival or inability to arrive, the guest must notify the owner as soon as possible.
The guest must communicate their expected arrival time by SMS or WhatsApp to +262 692 77 94 14 no later than noon on the day before arrival, and preferably as soon as their schedule is known. Any subsequent change, delay or later arrival must be reported immediately by the same means.
Article 7 – Departure
Guests must depart by 4:00 pm at the latest. Any unauthorised late departure may result in compensation equivalent to 10% of the price of an additional night, plus justified additional costs if the delay disrupts operations, cleaning or the arrival of subsequent guests.
Any compensation or costs payable under this article are deducted from the security deposit up to the amount due, after the guest has been informed and the relevant supporting evidence provided. The guest may instead choose to pay directly on site in cash; in that case, no corresponding deduction is made from the security deposit and a receipt is issued.
Article 8 – Use of the premises, respect for neighbours and authorised events
The guest undertakes to use the premises peacefully and in accordance with their intended purpose, the neighbourhood, equipment, house rules and these Terms and Conditions.
With the owner’s prior agreement, the villa may host quiet, supervised private events: hen parties, stag parties, birthdays, marriage proposals, family meals, reunions or group stays compatible with the peaceful character of the premises.
Villa Danatea is neither a party venue nor a place for noisy celebrations, dance parties, gatherings with amplified sound or events likely to disturb neighbours. Music must remain at a moderate volume. Quiet hours must be respected from 10:00 pm to 8:00 am. Shouting, singing, excessive bass, noisy groups and powerful outdoor speakers are prohibited.
The owner may refuse, interrupt or stop any non-compliant behaviour or event. If law enforcement intervenes for noise disturbance during the day or night, a flat amount of €500 may be retained from the security deposit, provided the breach is established and the amount justified, without prejudice to additional compensation for greater proven damage.
Article 9 – Capacity, visitors and non-staying guests
The booking is based on the declared number of people. Maximum accommodation capacity is 18 people, including adults, children and babies.
Anyone not included in the stay, including visitors and non-staying guests, must receive prior approval from management before entering the villa. The guest must provide each person’s first and last name. An additional charge may apply, provided its amount or calculation method has been communicated to and accepted by the guest before that person enters the villa.
For any reception expressly approved by management, the charge for non-staying guests is applied as a flat fee, whose amount is communicated to and accepted by the guest before confirmation of the reception.
For any reception, event or gathering expressly authorised by management that includes one or more non-staying guests not included in the accommodation booking, the cleaning package corresponding to the booked configuration is systematically included in the service.
The guest is informed of this condition before final confirmation of the reception. Where applicable, it appears on the quotation, rate proposal, booking summary or relevant invoice.
Any change to the number of people staying must be reported before arrival. The owner may accept or refuse an additional person on grounds of capacity, safety, insurance, operations and the neighbourhood.
If an adjustment is accepted: €40 per adult per night, €20 per child per night, €15 per person for linen, consumables and any logistical adjustments, plus the applicable additional tourist tax.
If undeclared occupancy is identified and not regularised, a flat compensation payment of €150 is due, without prejudice to additional charges, justified deductions from the security deposit and any damages. If the guest refuses to regularise the situation or capacity is exceeded, access may be refused or the stay terminated due to the guest’s breach.
Article 10 – Cleaning, waste, barbecue and departure
10.1 – Cleaning by the guest
Without a cleaning package, the premises must be returned clean and tidy: dishes washed, dried and put away; bins emptied; shared areas tidied; perishable food removed from refrigerators; air conditioning and lights switched off; and bath linen gathered as instructed.
If cleaning is insufficient, the corresponding package and any justified exceptional costs may be charged and deducted from or debited against the electronic security deposit, on presentation of supporting evidence.
10.2 – Disposal of glass bottles and packaging
Glass bottles, jars and containers must be emptied and taken by the guest to one of the nearest public glass recycling banks. They must not be placed in the bins or containers provided at Villa Danatea.
Where the breach is identified before the premises are finally vacated and can still be corrected, the guest is first asked to remove the glass personally. Failing this, if Villa Danatea must sort, safely handle and transport the glass, a flat remedial charge of €50 may be invoiced and deducted from the security deposit after the breach has been established and the guest informed.
If the actual, substantiated remedial cost exceeds €50, particularly where glass is broken or the volume is exceptional, only the justified excess may be claimed, without double charging.
10.3 – Barbecue
The barbecue is excluded from all cleaning packages and must be cleaned after use. Otherwise, €95 may be charged and deducted from the electronic security deposit.
10.4 – Cleaning package
- T2 Margouillat: €65
- T2 Paille-en-Queue: €65
- T4 Dauphin: €125
- Exclusive villa booking for up to 15 people: €220
- Exclusive villa booking for 16 to 18 people: €270
When an authorised reception, event or gathering includes one or more non-staying guests not included in the accommodation booking, the cleaning package corresponding to the booked configuration is systematically included in the service, in accordance with Article 9.
Including the cleaning package does not release the guest from returning the premises in a reasonable, orderly condition. Equipment and furniture used must be put back in place, dishes gathered and put away, food left by the group removed from refrigerators, waste gathered and disposed of according to Villa Danatea’s instructions, and the areas used left without unusual soiling or excessive disorder.
The cleaning package covers standard cleaning of the premises. Guests are therefore not required to perform the cleaning normally included in that service, but must still meet the obligations to tidy up, dispose of waste and return the premises in a normal condition under these Terms and Conditions and the house rules.
The package covers standard cleaning only. It specifically excludes the barbecue, damage, unusual soiling, waste left outside designated areas, glass not removed and any exceptional restoration. These situations may result in additional charges under these Terms and Conditions.
10.5 – Departure inspection
An inspection may be carried out. Any delay or late departure that disrupts cleaning or operations may lead to justified additional charges after the guest has been informed.
Article 11 – External caterers and culinary services
Only the partner caterer listed by Villa Danatea is authorised to use the kitchen equipment provided. All other caterers must use their own equipment and power supply system, in accordance with the regulations.
The use of an external caterer must be declared in writing no later than seven days before the stay. Villa Danatea may refuse access to a provider who does not comply with these conditions.
Where non-compliance is established, the guest is liable for damage and a flat penalty of €200 may be deducted from the security deposit, subject to supporting evidence and statutory proportionality rules. Additional compensation may be claimed if the proven damage exceeds this amount.
Article 12 – Alcoholic drinks
Villa Danatea sells alcoholic drinks in accordance with its declared authorisations and applicable regulations. Selling, offering or supplying alcohol to a minor is prohibited. Identification may be requested; in case of doubt or refusal, the sale will be refused.
Wines and champagnes ordered in advance through the website are reserved for adult purchasers and may be handed over after an identity check. Some drinks may also be offered in the apartments, with prices shown via a QR code. Consumption constitutes a sale and makes the price immediately payable.
The guest signing the rental agreement must prevent access to and consumption of alcohol by minors and ensure their group and visitors comply with this rule. In case of non-compliance, Villa Danatea may refuse or interrupt the service, charge for any established consumption, apply contractual measures and, if necessary, report the situation to the authorities.
Article 13 – Contractual consistency with the house rules
The house rules provided, displayed, sent electronically or accepted online form an integral part of the conditions of the stay. In the event of an apparent contradiction, the interpretation that best protects the safety of people, neighbours, property and the peaceful character of the premises prevails, subject to mandatory statutory provisions.
Article 14 – Acceptance of the Terms and Conditions of Sale
Payment of the advance, online confirmation, signing the agreement or entering the premises constitutes acceptance of these Terms and Conditions and the house rules. In particular, the guest acknowledges having read the provisions on the absence of a right of withdrawal, cancellation, schedules, capacity, visitors, quiet, cleaning and possible deductions.
Any penalty or deduction requires an established breach. Amounts must be justifiable and remain subject to statutory provisions on proportionality and contractual penalties, in particular Article 1231-5 of the French Civil Code.
Article 15 – Personal data
15.1 – Data controller
The data controller is SCI SAGICORN – Villa Danatea Location Saisonnière, represented by its manager, David GRONDIN. For questions about personal data or to exercise their rights, guests may write to danatea.location@gmail.com.
15.2 – Data collected and purposes
Only necessary data may be collected: the guest’s identity and contact details, information about occupants and authorised visitors, booking and stay details, announced arrival time, contractual and invoicing information, correspondence, complaints, any incidents, and information establishing which version of the Terms was sent, opened or confirmed.
These data are used to respond to enquiries, prepare and manage bookings, perform the accommodation agreement, organise the welcome, protect people and property, process payments and invoicing, manage complaints and disputes, meet legal obligations and retain evidence of contractual commitments.
15.3 – Legal bases
- Taking steps requested by the guest before entering into a contract and performing the accommodation agreement;
- Compliance with legal obligations, particularly accounting and tax obligations;
- Villa Danatea’s legitimate interest in securing the premises, preventing abuse, defending its rights and retaining necessary evidence;
- The guest’s separate consent where required for marketing.
15.4 – Public and identified access to the Terms
Public consultation of these Terms remains free and anonymous. Villa Danatea also offers an optional identified consultation process for guests, accompanying persons, representatives and other relevant third parties.
To use this process, the person provides their last name, first name and email address; the booking reference is optional. A single-use code, valid for fifteen minutes, is sent to the stated address to verify it. After verification, opening the identified version is recorded with the date, time, language and version of the Terms.
When this identified opening occurs, a notification is automatically sent to danatea.location@gmail.com. It specifies the last name, first name, verified email address, booking reference if provided, date, time, language and version of the Terms concerned.
Opening the document establishes only that the relevant version was accessed; it does not, by itself, prove that the document was read in full or accepted. A separate action allows the person voluntarily to confirm having consulted the Terms. This confirmation is recorded and notified separately. Consultation data are never used for a newsletter or marketing.
15.5 – Recipients and processors
Data are accessible only to authorised persons within SCI SAGICORN and, strictly as necessary, service providers involved in website hosting, booking, payment, messaging, maintenance, accounting or defending rights. They may also be disclosed to legally authorised authorities. They are neither sold nor rented.
Where a provider processes data outside the European Economic Area, the transfer must be subject to the safeguards required by applicable regulations.
15.6 – Retention periods
- Incomplete code request: automatic deletion after fifteen minutes;
- Identified opening or confirmation log and information useful as evidence: a maximum of five years from the last recorded event;
- Contractual file and information useful for defending rights: during the contractual relationship, then five years;
- Invoices and accounting records: ten years in accordance with legal obligations;
- Data used for authorised marketing: three years after the last contact, or until consent is withdrawn if earlier.
15.7 – Individual rights
Under the conditions provided by the regulations, any person concerned may request access to, rectification or erasure of their data, restriction of processing, portability where applicable, or object to certain processing. Consent may be withdrawn at any time where processing is based on consent. Proof of identity may be requested only where there is reasonable doubt about the requester’s identity.
Requests should be sent to danatea.location@gmail.com. If a difficulty remains unresolved, the person concerned may lodge a complaint with the CNIL.
15.8 – Security
SCI SAGICORN implements appropriate technical and organisational measures to protect data against unauthorised access, loss, alteration or disclosure. The verification code is temporary and identified logs are accessible only to persons with the necessary administration rights.
Article 16 – Complaints
Any complaint must first be addressed to Villa Danatea Location Saisonnière by email at danatea.location@gmail.com or by telephone on 06 92 77 94 14. Legal correspondence should be sent to the same email address.
Article 17 – Consumer mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, every consumer has the right to use a consumer mediation scheme free of charge to seek an amicable resolution of a dispute with SCI SAGICORN – Villa Danatea Location Saisonnière.
Before requesting mediation, the guest must first submit a written complaint to Villa Danatea in an attempt to resolve the dispute directly.
This complaint may, in particular, be emailed to: danatea.location@gmail.com
If no satisfactory amicable solution is found, the consumer may refer the matter free of charge to the competent consumer mediator, in accordance with the legal provisions in force and the arrangements communicated by SCI SAGICORN.
Mediation is an amicable, optional procedure. It does not deprive either the consumer or SCI SAGICORN of the right to bring the matter before the competent court if the attempt at amicable resolution fails.
Article 18 – Applicable law and dispute resolution
These Terms and Conditions and any booking agreement concluded with SCI SAGICORN – Villa Danatea Location Saisonnière are governed by French law.
In the event of any difficulty in interpretation or performance, or any dispute, these terms are interpreted in accordance with French law. Where the guest is a consumer residing in another country, this choice must not deprive them of the mandatory protective provisions that would otherwise necessarily apply.
Force majeure
Force majeure is assessed in accordance with Article 1218 of the French Civil Code. In the event of a temporary impediment, performance is suspended under the conditions provided by law, unless the delay justifies termination. In the event of a permanent impediment, the agreement is terminated by operation of law under the statutory conditions. The parties may agree in writing to a postponement, credit note or another amicable solution, without removing applicable statutory rights.
